1. Acceptance of Terms
By accessing or using Insta Automate ("the Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to all of these Terms, you may not use the Service.
These Terms apply in addition to Meta's Platform Terms and Instagram's Community Guidelines. You are responsible for ensuring your use of the Service complies with all applicable laws and Meta's policies.
2. Description of Service
Insta Automate is an Instagram automation tool that allows Instagram Business and Creator account holders to automatically send Direct Messages to users who comment on their posts using specific keywords. The Service operates through the official Meta Graph API.
3. Eligibility
- You must be at least 18 years of age to use the Service
- You must own or have authorization to manage the Instagram account(s) you connect
- Your Instagram account must be a Business or Creator account
- You must not be located in a jurisdiction where the Service is prohibited
4. Account Registration
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at support@instautomate.app of any unauthorized use of your account.
We reserve the right to terminate accounts that violate these Terms or Meta's Platform Policies.
5. Acceptable Use
You agree NOT to use the Service to:
- Send spam, unsolicited commercial messages, or harassing content
- Violate Meta's Platform Terms, Instagram's Community Guidelines, or any applicable law
- Send messages containing illegal content, hate speech, or adult content
- Impersonate any person or entity
- Circumvent Instagram's rate limits or messaging policies
- Automate interactions in a way that degrades the experience of Instagram users
- Resell or sublicense access to the Service without written permission
- Attempt to reverse-engineer, decompile, or extract source code from the Service
Violation of these terms may result in immediate suspension of your account and potential reporting to Meta.
6. Meta Platform Compliance
The Service operates under Meta's Developer Policies and Platform Terms. Key constraints include:
- Private replies (comment-to-DM) must be sent within 7 days of the comment
- Follow-up messages can only be sent after the recipient responds
- API rate limits apply (200 DMs/hour per account)
- Messages that violate Meta's policies will be rejected by the API
- Users can opt out of automated messages at any time by replying STOP
We are not responsible for delivery failures caused by Meta's API restrictions, rate limiting, or policy enforcement. Changes to Meta's policies may affect Service functionality without prior notice.
7. Payment and Billing
- Subscription fees are billed in advance on a monthly or annual basis
- All fees are non-refundable except where required by law
- We reserve the right to change pricing with 30 days' notice
- Failure to pay may result in suspension of your account
- You are responsible for all applicable taxes
8. Intellectual Property
The Service, including its design, code, trademarks, and content, is owned by Insta Automate and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose during your subscription period.
Content you create (automation messages, keywords, flows) remains your intellectual property. You grant us a license to process this content solely to provide the Service.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or that all DMs will be successfully delivered. Instagram API availability and Meta's policies are outside our control.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, INSTA AUTOMATE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF YOUR USE OF THE SERVICE.
Our total liability to you for any claims arising under these Terms shall not exceed the amount paid by you to us in the 3 months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless Insta Automate, its officers, directors, employees, and agents from any claims, damages, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights or Meta's policies.
12. Termination
Either party may terminate the agreement at any time. We may suspend or terminate your access immediately for violations of these Terms. Upon termination, your right to use the Service ceases and your data will be deleted per our Privacy Policy.
13. Governing Law
These Terms shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in India.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance.
